Queensland

Eligibility Criteria

  • At least $800,000AUD net business and personal assets
    • Must be transferred to Queensland within 2 years of visa grant
  • At least $200,000AUD for investment in business
  • Commit to living in Queensland
  • Entry level businesses will not be accepted for Brisbane and Gold Coast regions
    • Includes small wine export, travel, tourism, retail and hospitality ventures
      • These businesses will only be considered in other regional areas
  • Preference given to applicants who select ‘Queensland’ as their nominating choice over applicants who select ‘any’

  • Meet complying investment framework set by Austrade
  • Provide details of your complying investment intentions 
  • Commit to living in Queensland with additional investments indicated 
  • Preference given to applicants who select ‘Queensland’ as their nominating choice over applicants who select ‘any’

Queensland - 188E

Eligibility Criteria 

  • Have a funding agreement of at least $200K AUD to undertake a complying entrepreneur activity
  • Provide a comprehensive company business plan demonstrating: 
    • An entrepreneurial activity which relates to an innovative idea that is proposed to lead to the commercialisation of: 
      • A new or improved product or service or 
      • The development of a new enterprise of business
        • Cannot be residential real estate, labour hire or purchase of existing enterprise or a franchisee in Australia  
  • Proof of at least 30% share in the ownership of the entrepreneurial entity at the time of entering in to the agreement 
  • Proof of sufficient settlement funds 
  • Commit to living in Queensland 
  • Preference given to applicants who select ‘Queensland’ as their nominating choice over applicants who select ‘any’

Application Process

New South Wales

Eligibility Criteria

  • Less than 55 years of age
    • Rarely exercises provision to waive this requirement based on exceptional economic benefit exemption 
  • If seeking to migrate to Sydney:
    • For at least two of the four fiscal years immediately before the application is made, you must have had a qualifying ownership interest in up to 2 main businesses that had an annual turnover of at least A$1.0 million
      • The ownership share must be at least 51% of a business with turnover of less than A$400,000 per annum, or 30% of a business with turnover of more than A$400,000 per annum, or 10% of a publicly-listed company.
    • Net personal and business assets of at least A$1.3 million
    • Business commitment must include at least A$500,000 in business investment
      • The business investment must be in property, plant & equipment, inventory, or purchased goodwill
  • If seeking to migrate to regional NSW (all areas outside of postcodes 1000-1920, 2000-2249, 2555-2574, 2740-2786)
    • For at least two of the four fiscal years immediately before the application is made, you must have had a qualifying ownership interest in up to two main businesses that had an annual turnover of at least at least A$500,000 (in line with Department of Home Affairs criteria).
    • Net personal and business assets of at least at least A$800,000
    • Business commitment must include at least A$300,000 in business investment
      • The business investment must be in property, plant & equipment, inventory, or purchased goodwill
  • Full resume of your business career and responsibilities demonstrating a successful business career
  • Provide proposed business activity overview including details on why you have chosen to establish a business in NSW and the product/service you will provide
  • Evidence of the availability of funds for settling and living expenses for not less than one year
    • Bank statements, trusts, passbooks, shares
  • Will also assess visa criteria

Eligibility Criteria

  • Provide a signed statement agreeing to make a designated investment with the NSW Treasury Corporation
  • Provide a full resume of your business or investment career and responsibilities demonstrating a successful business or investment career
  • If seeking to migrate to Sydney:
    • For the two years immediately before the application is made, the net value of your (or your and your spouse’s) assets was at least A$3.0 million
  • If seeking to migrate to regional NSW (all areas outside of postcodes 1000-1920, 2000-2249, 2555-2574, 2740-2786):
    • For the two years immediately before the application is made, the net value of your (or your and your spouse’s) assets was at least A$2.25 million
    • Evidence of the availability of funds for settling and living expenses for not less than one year
  • Will also assess visa criteria

  • Demonstrate that the net value of the business and personal assets is sufficient to support your settlement expenses in NSW

Eligibility Criteria 

  • Be under 55 years of age
  • Business activities generally excluded:
    • Small scale property development
    • Small scale freight forwarding and warehousing
    • Commodity and scrap metal export
    • Passive investment 
  • Demonstrate that business will make contribution to Victorian economy and that applicant will be responsible for day-to-day operation and overall strategic direction of business 
    • If proposing export business activity should demonstrate:
      • the export value of Victorian goods and services
      • Victorian jobs created or retained, including flow-on effects to other Victorian suppliers
      • the local economic benefits of the business
      • assistance to Victorian businesses in exporting their products or addressing market gaps
      • the expansion of export markets
      • other examples depending on the nature of the business.
        • Cannot import goods and sell them in an export market without consent of owner of goods trademarked 
  • Sufficient funds to settle in Victoria 
  • Genuine commitment to establish a residence and reside in Victoria 
  • Have an understanding of commercial challenges for proposed business 
  • Agree to nomination obligations 
    • Meet DHA criteria
    • Will contact Victorian government within one month of arrival in Victoria
    • Engage in business activity within 23 months of visa grant
    • Have at least $400,000AUD for business activity 
    • Will not transfer nomination to another State or Territory

Victoria - 188B

Eligibility Criteria

  • Be under 55 years of age
  • Genuine commitment to establish a residence and reside in Victoria
  • Invest at least $1.5M in Victorian Treasury Corporation
    • US citizens may be excluded
    • May be excluded if a national of, reside in, or sending funds from, a country that has been sanctioned by Australian government 
  • Engage in a business or investment activity 
    • Investment activity must be non-passive
    • Must regularly monitor and actively manage investment
      • i.e managing stocks, real estate or investing in a company 
    • Must provide economic benefit to Victoria 
  • Sufficient funds to settle in Victoria
  • Agree to nomination obligations
    • Meet DHA criteria 
    • Will contact Victorian government within one month of arrival in Victoria
    • Engage in business or investment activity within 36 months of arrival
    • Will not transfer nomination to another State or Territory

    • Minimum of $1.5M in emerging companies
  • Investment will make a contribution to Victorian economy because:
    • VC/PE fund actively sourcing investment in Victoria; or
    • VC/PE fund provider maintain an office in Victoria; and
    • Victorian investment is included in chosen investment; or
    • Managed fund provider maintains office in Victoria 
  • Fund manager has provided sufficient information regarding the terms and conditions of investment and financial risk involved
  • Sufficient funds to settle in Victoria
  • Genuine commitment to establish a residence and reside in Victoria
  • Agree to nomination obligations 
    • Meet DHA criteria
    • Will contact Victorian government within one month of arrival in Victoria
    • Will not transfer nomination to another State or Territory

  • Entrepreneurial activity must be for the commercialisation of a new or improved product or service, or the development of a new enterprise 
    • Cannot be a regular business (i.e accountancy firm)
    • Creates better solutions for businesses, consumer, the economy and society
      • i.e creates jobs, improves efficiencies and addresses barriers to growth
  • Provide a business plan
  • Entrepreneurial activity will benefit Victoria:
    • The nature of the innovation, whether it increases efficiencies, creates a dynamic product or improves existing services
    • The potential economic contribution to be made to Victoria by the innovation, as well as any social or environmental benefits
    • Whether the innovation addresses a significant need in an industry sector in Victoria
    • Whether the innovation is likely to lead to employment opportunities for Victorians
    • Whether a patent, design or trademark has been registered for the innovation
  • Must also demonstrate:
    • the third party funding body has Victorian operations; or
    • the entrepreneurial activity will be undertaken in Victoria.

  • Successful record of business or investment activity 
  • Undertaken comprehensive business research and planning to demonstrate realistic understanding of investment in Tasmanian context
  • Proposed activity has a genuine benefit to Tasmania 
    • May include investment in:
      • Food and beverage production
      • Tourism
      • Aquaculture and Agriculture
      • Minerals and mining industry
      • Forestry and timber
      • Antarctic and marine science
      • Information and communications technology
      • Arts and Creative industries
    • Other factors:
      • Flow on benefits to other areas of the economy
      • Introduction of new skills, technology, innovations
      • Creation of jobs
      • Trade expansion
      • Innovation
      • Investment outside Greater Hobart
  • If activity is property development:
    • A minimum AUD 1.5 million investment leading to creation of at least 4 properties for general sale or tourism, low income or student accommodation.
    • Property development must add to stock of housing available for general sale or for increasing tourism, low income, or student accommodation.
    • Sale of developed property must be at arm’s-length (not to a known or related individual/business)

      • minimum $500,000 investment in a ‘balancing’ investment component that includes significant Tasmania based investments.

    • Invest at least $200,000 to purchase or establish a business in the ACT; and/or
    • Invest at least $600,000 investment in personal and business assets in the ACT; and/or
    • Employ at least the equivalent of two full-time employees who are Australian citizens, Australian permanent residents or New Zealand passport holders, and are not your family members
  • Genuine commitment to reside in ACT
  • Sufficient funds to settle in ACT
  • Agree to obligations:
    • Will not transfer nomination 
    • Can transfer net business and personal assets within 6 months of visa grant
    • Provide expected arrival date
    • Settle in ACT within 6 months of visa grant 
    • Will complete 6 monthly business activity surveys

    • Invest a minimum $500,000 into Significant Capital Ventures, a Significant Investor Visa compliant early stage Venture Capital Limited partnership that complies with Part A of the Complying Investment Framework (see www.significantcapitalventures.com.au); and invest the remaining funds in Part B and C of the Complying Significant Investment Framework; or
    • Invest at least $500,000 into a Complying Significant Investment that is of economic benefit to the ACT; and
      • For example in a: 
        • Venture capital and growth private equity fund investing in start-ups and small private companies in the ACT; or 
        • Venture Capital Limited Partner (VCLP) fund component in a fund that is actively sourcing investment in the ACT; 
    • Invest the remaining funds in Part B and C of the Complying Significant Investment Framework

Application Process

    2. Evidence that the proposed complying significant investment is of economic benefit to the ACT. This may include:

        2. Signed letter of intent with the managing fund to invest in the complying investments; and
